Last updated: 10/04/2026

Article 1 – Seller Details

The website www.mamourdebio.it is operated by AKOSS COSMETICS SRL, with registered office at Corso Felice Cavallotti 60, 15121 Alessandria (AL), Italy, a share capital of €30,000.00, and is registered with the Alessandria Companies Register with company number REA AL-315493, VAT Number 12699500018, email address support@mamourdebio.com.

For the purposes of these General Terms and Conditions of Sale, AKOSS COSMETICS SRL is also referred to as the “Seller”.

Article 2 – Scope

These General Terms and Conditions of Sale (the “Terms”) govern purchases made remotely through the website www.mamourdebio.com by consumers as defined under the applicable law.

“Consumer” means any individual acting for purposes outside their work, business, trade or profession, also referred to in this document as the “Customer”.

These Terms apply exclusively to business-to-consumer sales made and delivered in Italy and in the other European Union member states listed on the website and/or at checkout from time to time. Sales to business customers are governed by separate terms and conditions.

The Terms applicable to any order are those published on the website at the time the order is submitted.

The Seller reserves the right to amend these Terms at any time. Any amendments will not apply to orders already placed before the date of their publication.

Article 3 – Product Information

The products offered for sale on the website are cosmetic and dermo-cosmetic products designed in particular for the skin of newborns, children and families, and comply with applicable European cosmetics regulations.

The key characteristics of each product are set out in the relevant product pages on the website, including, where applicable, product size, directions for use, safety information, ingredients/INCI list and any other information useful to the Consumer.

Images, videos, colours, packaging and graphic elements on the website are for illustrative purposes only. Whilst every effort is made to represent products as accurately as possible, the Seller cannot guarantee an exact match between the on-screen appearance and the actual product, in particular due to differences in how colours and images are displayed across devices, where minor changes to the packaging have been made.

Products are available for sale subject to stock availability.

Article 4 – Intended Use and Safety Information

Unless otherwise expressly stated in the product description or on the product label, all products are intended for external use only.

Customers are asked to read the product description, INCI list, warnings, directions for use and any other information provided on the website and/or on the product carefully before use.

If you have known allergies, particular sensitivities, broken skin, a history of reactions, or any concerns about using a product on newborns, children or individuals with especially sensitive skin, we recommend consulting a doctor, paediatrician, pharmacist or other qualified healthcare professional beforehand.

This clause does not in any way affect the Consumer’s statutory rights.

Article 5 – Prices

All prices on the website are shown in euros and are inclusive of VAT, unless otherwise expressly stated.

Any delivery charges, where applicable, are shown separately before the order is confirmed.

The Seller reserves the right to change prices at any time. The price charged to the Customer will always be the price shown on the website at the time the order is submitted.

For deliveries to EU member states, the VAT applied will be that required under the tax rules in force at the time of the order.

Unless otherwise stated, any promotions, offers or complimentary items are valid for the period and on the conditions specifically indicated on the website.

Article 6 – How to Place an Order and Contract Formation

To place an order, select the products you wish to purchase and add them to your basket.

Before submitting your order, you can review the contents of your basket, make any changes, and update quantities, billing details, delivery address, and shipping and payment methods.

Submitting an order creates a payment obligation. The final order confirmation button clearly indicates that placing an order involves an obligation to pay.

Before submitting an order, the Customer is required to: read and expressly accept these Terms; confirm that they have read the Privacy Notice; and check that all information provided is accurate.

The Customer’s order constitutes an offer to purchase. The sale contract is formed when the Seller sends the Customer an order confirmation to the email address provided or, if earlier, a notification that the products have been dispatched.

The Seller reserves the right to decline, cancel or suspend an order where information provided is incomplete or inaccurate, a product is unavailable, there is a suspicion of fraud or misuse, payment has not been received or a transaction has failed, or there is an outstanding dispute with the Customer relating to previous payments or breaches of contract.

In such cases, the Customer will be notified and, where a payment has already been taken, any amounts received will be refunded without undue delay.

Article 7 – Product Availability

If, after an order has been submitted, one or more products are found to be wholly or partially unavailable, the Seller will notify the Customer promptly by email.

Where this occurs, the Customer will be offered the following options, where available: substitution of the unavailable product with an alternative of equivalent or different value, with any price difference settled accordingly; partial dispatch of the order; or full or partial cancellation of the order, with a refund of the amounts corresponding to the unavailable products.

Article 8 – Payment

Orders are paid for using the payment methods available on the website at checkout, including, by way of example, credit or debit cards, PayPal and any other electronic payment systems that may be activated from time to time.

Payment is due at the time the order is submitted.

Transactions are processed through secure payment services. The Seller does not store or directly handle full payment card details.

If a payment is declined, charged back, or found to be fraudulent or otherwise unauthorised, the Seller may refuse or cancel the order.

Any fees or charges applied by the Customer’s payment service provider are the Customer’s responsibility, unless otherwise required by law.

Article 9 – Delivery

Deliveries are made throughout Italy and to the other European Union member states available for selection on the website, to the address provided by the Customer at the time of ordering.

The Seller uses carriers and couriers of its own choosing. Available delivery options, associated costs and estimated delivery times are shown to the Customer before the order is finalised.

Unless otherwise agreed with the Customer, the Seller will deliver the goods without undue delay and in any event no later than 30 days from the date the contract is formed.

Any delivery times indicated on the website or in the order confirmation are estimates, unless the Seller has expressly guaranteed a specific date or deadline.

The Seller is not liable for delays caused by the Customer, incorrect or incomplete addresses, force majeure, carrier failures not attributable to the Seller, or extraordinary events outside the Seller’s reasonable control, without prejudice to the Customer’s statutory rights.

If delivery has not taken place within the applicable timeframe, the Customer may request that the Seller complete delivery within a reasonable additional period. If the Seller fails to do so, the Customer will be entitled to cancel the order and receive a full refund, without prejudice to any other statutory rights.

Once an order has been dispatched, the Customer will receive a tracking number where available.

Customers are asked to check the outer condition of the parcel upon delivery and to report any visible damage to the carrier and to the Seller’s customer service team without delay. Reporting any such issue is for organisational and evidential purposes and does not in any way affect the Customer’s statutory rights.

Article 10 – Transfer of Risk

The risk of loss or damage to the products passes to the Customer at the moment the Customer, or a third party nominated by the Customer, takes physical possession of the products.

Article 11 – Right of Withdrawal

The Customer has the right to withdraw from the contract, without giving any reason, within 14 calendar days from the day on which the Customer, or a third party nominated by the Customer, takes physical possession of the products.

To exercise the right of withdrawal, the Customer should contact our customer service team in advance at support@mamourdebio.com, providing the order number and details of the products concerned. The Seller will confirm receipt of the withdrawal request without undue delay and will provide the Customer with instructions on how to return the products, including the return address if different from the Seller’s registered office.

The right of withdrawal is considered validly exercised when the Customer communicates their decision to withdraw to the Seller within the legal timeframe by means of a clear and unambiguous statement.

The right of withdrawal may also be exercised using the model withdrawal form set out in Annex 1, though use of this form is not mandatory.

Article 12 – Consequences of Withdrawal, Returns and Refunds

Where the right of withdrawal has been validly exercised, the Customer must return the products to the Seller without undue delay and in any event within 14 days of the date on which the withdrawal was communicated by the Customer.

Unless otherwise expressly stated on the website, the direct cost of returning the products is the Customer’s responsibility.

The Customer is only responsible for any reduction in the value of the goods resulting from handling other than what is reasonably necessary to assess the nature and characteristics of the products.

A refund will be issued without undue delay and in any event within 14 days of the date on which the Seller was informed of the Customer’s decision to withdraw.

Unless the Seller has offered to collect the goods, the Seller may withhold the refund until the returned products have been received, or until the Customer has provided proof of return shipment, whichever is earlier.

The refund will be made using the same payment method used for the original transaction, unless expressly agreed otherwise.

Article 13 – Exceptions to the Right of Withdrawal

The right of withdrawal does not apply in the circumstances provided for by law and, in particular, to the supply of sealed goods which are not suitable for return on grounds of health or hygiene where the seal has been removed or broken after delivery.

For cosmetic products, this exception applies in particular to any product whose packaging, seal, closure or hygiene protection has been removed, opened, altered or tampered with after delivery.

This exclusion does not apply where the product is defective. In such cases, the Customer’s statutory rights remain fully unaffected.

Article 14 – Statutory Guarantee of Conformity

All products sold on the website benefit from the statutory guarantee of conformity.

The Seller is liable for any lack of conformity existing at the time of delivery that becomes apparent within 2 years of delivery.

Unless proven otherwise, any lack of conformity that becomes apparent within 1 year of delivery is presumed to have existed at the time of delivery, unless this is incompatible with the nature of the goods or the nature of the defect.

Where a lack of conformity is established, the Customer is entitled, within the limits set by law, to have the goods brought into conformity by repair or replacement or, where this is not possible or proportionate, to a price reduction or cancellation of the contract.

Claims relating to a lack of conformity will be subject to a limitation period of 26 months from the date of delivery, except where the Seller has deliberately concealed the defect.

To report a lack of conformity or request warranty assistance, the Customer may contact the Seller at support@mamourdebio.com providing: the order number; details of the relevant product; a description of the defect; and any supporting photographs where available.

These Terms do not exclude or limit in any way the Customer’s statutory rights.

Article 15 – Complaints and Customer Service

For any enquiries, assistance or complaints, the Customer may contact our customer service team at: email support@mamourdebio.com; or by post: AKOSS COSMETICS SRL, Corso Felice Cavallotti 60, 15121 Alessandria (AL), Italy.

The Seller undertakes to handle all complaints promptly and in good faith.

Article 16 – Liability

The Seller is not liable for damage resulting from misuse of the products, use that is contrary to the instructions provided, improper storage, use beyond the expiry date or the period after opening (PAO), or failure to observe the warnings set out on the product or on the website, without prejudice to the Customer’s statutory rights.

The Seller’s liability remains subject to statutory limits, including those relating to the statutory guarantee of conformity and, where applicable, liability for damage caused by defective products.

The Seller will not be liable for any delays or failures to perform its obligations caused by force majeure or by unforeseeable and unavoidable circumstances beyond its reasonable control.

Article 17 – Personal Data

The Customer’s personal data is processed by the Seller in accordance with data protection law.

The processing of personal data is governed by the Privacy Notice available on the website, which forms a part of the pre-contractual information provided to the Customer.

The Customer may exercise the statutory rights, including, where the conditions are met, the rights of access, rectification, erasure, restriction, portability, objection and the right to make a complaint to the competent supervisory authority, by contacting the Seller at the details set out in the Privacy Notice.

Article 18 – Intellectual Property

All content on the website, including, by way of example, text, images, photographs, videos, logos, trademarks, trade names, graphics, layouts, designs, databases, distinctive elements and editorial content, is the property of the Seller or the respective rights holders and is protected.

Any reproduction, distribution, communication to the public, modification, commercial use or other use of the website’s content without the prior written authorisation of the rights holder is strictly prohibited.

Article 19 – Out-of-Court Dispute Resolution

Consumers are encouraged to contact the Seller’s customer service team first to seek an amicable resolution to any dispute.

Consumers may also, where the legal conditions are met, refer disputes to alternative dispute resolution (ADR) through a competent body.

For cross-border disputes within the European Union, Customers may also contact the European Consumer Centre (ECC-Net) in their country of residence.

Where the Seller is required by law, or chooses voluntarily, to participate in a specific ADR scheme, the relevant details of that scheme will be made available on the website and in the applicable legal information.

Article 20 – Governing Law and Jurisdiction

These Terms and any sale contracts concluded through the website are governed by Italian law, without prejudice to any consumer protection provisions applicable under the law of the country in which the Consumer is habitually resident.

For any dispute relating to the interpretation, validity, enforceability, performance or termination of the contract, the Consumer retains the right to bring proceedings before the courts in their place of domicile or habitual residence.

Any provision found to be incompatible with the Consumer’s statutory rights will be automatically replaced by the applicable statutory provisions.

Article 21 – General Provisions

If any provision of these Terms is found to be void, invalid or unenforceable, the remaining provisions will continue in full force and effect.

Any failure by the Seller to exercise a right or remedy under these Terms does not constitute a waiver of that right or remedy.

These Terms are drafted in Italian. In the event of translation into other languages, the Italian version shall prevail in the event of any discrepancy, unless the mandatory consumer protection laws of the country in which the Consumer is habitually resident provide otherwise.
